Terms of Service

The agreement that governs your access to Nefer, the people who depend on you, and the people behind us. Please read it carefully.

Introduction

Nefer Remittance Limited is a Canadian corporation authorized and regulated by FINTRAC to provide foreign exchange and money transfer services.

These Terms & Conditions govern your access to and use of our services. By creating an account or using any Nefer service, you agree to comply with these terms.

About These Terms

Contract

Your use of our services is governed by these Terms together with our Privacy Policy. By accessing or using Nefer, you confirm that you have read, understood, and accepted both documents.

If you do not agree with these terms, you should not use our services.

Changes to These Terms

We may update these Terms from time to time.

  • You'll be notified before significant changes take effect unless the law requires immediate implementation.
  • Updated terms become effective once published.
  • Continued use of Nefer means you accept the revised Terms.
  • Changes apply only from their effective date and do not affect previous transactions.

Prohibited Use

You may not use Nefer for any unlawful purpose, including:

  • Money laundering
  • Fraud
  • Terrorist financing
  • Sanctions evasion
  • Any activity prohibited by applicable law

Where required, Nefer may report suspicious activity to the appropriate regulatory authorities.

Section 03

Account Registration

Registration

Before using our services, you must create a Nefer account.

During registration you agree to:

  • Provide complete and accurate information.
  • Keep your information up to date.
  • Submit requested verification documents.
  • Allow identity verification through approved third-party providers.

You also authorize Nefer to perform verification checks, including enquiries with credit bureaus where legally permitted.

Eligibility

To use Nefer, you must:

  • Be at least 18 years old.
  • Not appear on any sanctions list.
  • Not be a prohibited Politically Exposed Person where applicable.
  • Meet Nefer's Anti-Money Laundering requirements.
Section 04

Liability

Indemnification

You agree to indemnify and hold Nefer Remittance Limited harmless against losses, claims, damages, legal costs, and expenses resulting from:

  • Breaching these Terms.
  • Violating applicable laws.
  • Providing inaccurate information.
  • Fraudulent or unlawful activity.
  • Misuse of your account.
  • Unauthorized access caused by failure to protect your credentials.

Limitation of Liability

To the extent permitted by law, Nefer is not liable for indirect or consequential losses, including:

  • Loss of profits
  • Business interruption
  • Data loss
  • Exchange rate fluctuations
  • Delays caused by financial institutions
  • Regulatory reviews
  • Technical outages
  • Third-party service failures

Our total liability for any claim will not exceed:

  • The fees paid for the affected transaction, or
  • CAD $100, whichever is greater.

Reliance on Your Information

You are responsible for ensuring that all beneficiary and payment information is accurate.

Nefer may rely entirely on the information you provide and is not responsible for losses resulting from incorrect payment details.

Cancellation of Instructions

Once a payment instruction has been received, it generally cannot be cancelled.

Where possible, Nefer may attempt a reversal; however, successful reversal cannot be guaranteed.

A cancellation fee of CAD 3.50 applies.

Section 05

Suggestions

If you submit ideas, recommendations, or feature suggestions, Nefer may use them without restriction or compensation.

Section 06

Privacy

Your privacy is important to us.

As a regulated financial institution, we may share your information with:

  • FINTRAC
  • Regulatory authorities
  • Law enforcement agencies
  • Credit bureaus
  • Identity verification providers
  • Banking and financial partners

Section 07

Termination & Enforcement

Notice of Termination

Either you or Nefer may terminate this agreement at any time, with or without notice.

Enforcement Action

Where necessary, Nefer may take appropriate enforcement measures, including:

  • Recovering outstanding amounts
  • Engaging third-party collection agencies
  • Commencing legal proceedings
  • Exercising rights permitted under applicable law
Section 08

Other Terms

Nefer may delay, suspend, or refuse a transaction where necessary to:

  • Complete compliance reviews
  • Meet AML or sanctions obligations
  • Prevent fraud
  • Satisfy regulatory requirements

If a transaction is flagged for review, it may remain on hold until the matter is resolved.
